Terms of Service

The short version

  • FlowPilot is a business tool. You must be at least 18 and use it for a business.
  • FlowPilot Free makes invoices. The paid plans (Starter, Inventory, Professional, Max) are monthly subscriptions bought through Apple in the iPhone app or, for some plans, on the web. They renew automatically until you cancel.
  • You cancel App Store subscriptions in your Apple ID settings; refunds for App Store purchases are handled by Apple under Apple's terms.
  • The customer data you put into FlowPilot (leads, phone numbers, messages, device records) is yours, and you are responsible for having the right to use it, including consent to text or call people.
  • We text you about your account only with your consent, and you can reply STOP at any time. See the Messaging Terms.
  • Device-check results and AI-generated messages are helpful but not guaranteed. Check them before you rely on them.

1.Who we are and what these Terms cover

FlowPilot Suite and the FlowPilot Leads app (shown on the phone as FlowPilotLeads) are provided by Flow Pilot Suite LLC, a limited liability company formed in Florida, at 5455 Latches Ln, Lakewood Ranch, FL 34211 ("FlowPilot Suite", "we", "us"). These Terms of Service ("Terms") are a binding agreement between us and the business that creates an account ("you"). They cover the FlowPilot Leads iPhone app, the web app and operator portal at flowpilotleads.com, the website flowpilotsuite.com, and every related service, feature and communication (together, the "Service").

For the iPhone app itself, Apple's standard Licensed Application End User License Agreement is the licence under which the app is provided; these Terms govern the Service you use through it (see Section 22).

By creating an account, tapping "agree", subscribing, or using the Service, you accept these Terms, our Privacy Policy, which explains how we handle personal information, and our Messaging Terms, which cover the text messages we send; both are part of these Terms. If you are accepting for a company, you confirm you have authority to bind it.

2.Eligibility and accounts

The Service is for businesses and business use only. You must be at least 18 years old and able to enter into a binding contract. The Service is not directed to children and we do not knowingly let anyone under 18 open an account.

You sign in with Google, with Apple, or with an email address and password. The person who creates the account is its administrator and is responsible for everyone they invite (drivers, staff, partner businesses). Keep your sign-in secure, tell us promptly about any unauthorised access, and make sure the information on your account and Business Info is accurate and stays current. We may rely on it to set up your business number, your AI and your communications.

You can delete your account at any time from Settings in the app. Deletion is described in the Privacy Policy and on our Support page.

3.The free account

FlowPilot Free lets you type in devices, make an invoice, and send it to a FlowPilot buyer you are linked with or save it as a PDF. It does not include inventory or messaging, and it does not keep a record of the invoices you make; save the PDF if you need one. The rest of the app is shown as a locked preview. We may change what the free account includes, and we may close free accounts that stay unused for a long time, with notice where practical.

4.Paid plans and App Store subscriptions

These are the plans, all billed monthly in U.S. dollars. Prices shown by the App Store before you confirm may differ by storefront and include applicable tax.

Sold in the FlowPilot Leads app as auto-renewing subscriptions: FlowPilot Starter, one month, $9.99; FlowPilot Inventory, one month, $99.99 ($89.99 with the sign-up offer); FlowPilot Professional, one month, $199; FlowPilot Max, one month, $299.

Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. Manage or cancel subscriptions in your Apple ID account settings after purchase. Any unused portion of an introductory offer is forfeited when you buy a subscription.

The sign-up offer. New accounts may be offered FlowPilot Inventory at $89.99 per month for a limited time, which begins when the account finishes its first invoice. The offer price is the price of that subscription for as long as it stays active; if the subscription lapses, a new subscription is at the standard price.

Moving between plans. You can switch plans in the app. Moving to a higher plan takes effect immediately and Apple charges a prorated amount for the rest of the current period. Moving to a lower plan takes effect at your next renewal; you keep your current plan until then.

Price changes. If a price changes, Apple will tell you in advance and, where Apple's rules require it, ask you to agree before the new price applies. If you do not agree, your subscription ends at the close of the current period. Prices on the web can change with notice on our Pricing page.

Set-up steps. Professional and Max are opened to a customer by us; contact us to get started. Both come with a local business phone number set up by FlowPilot. To do that we need the Business Info you are asked to complete after purchase. Some set-up is performed by our team and can take up to two business days after you complete it.

5.Usage billing, web plans and device checks

Professional and Max are billed monthly. Messaging, call minutes and AI replies are billed separately at cost plus 2x; you add a card for usage inside your account and every charge is itemised there. Inventory, Starter and Free have no usage billing.

Plans bought on the web are billed monthly by Flow Pilot Suite LLC through our payment processor, Stripe, and cancel any time effective at the end of the paid period. Taxes may apply.

Most device checks are included in your plan at no extra charge. Premium device checks are not offered in this release.

6.Changing, cancelling and refunds

Cancelling stops future renewals; it does not shorten the period you have already paid for, and you keep access until that period ends. App Store purchases are governed by Apple's terms: refund requests go to Apple through reportaproblem.apple.com, and Apple decides them. Web purchases are refundable where the law requires it and otherwise at our reasonable discretion; contact us within 14 days of a charge you believe is wrong.

When a subscription ends, is refunded or is revoked, your account returns to FlowPilot Free. Your data stays on your account (see Section 7) but paid features lock until you subscribe again.

7.Your data and your customers' data

Everything you put into FlowPilot about your business, your inventory, your customers, your leads and your conversations is your data. You own it. You give us a licence to store, process, transmit and display it only as needed to run the Service for you, to provide support, to keep the Service secure and reliable, and as the Privacy Policy describes.

You are responsible for your data: for having the right to collect and use it, for its accuracy, and for how your staff and partner businesses use it. When you send an invoice, an order or a message to another FlowPilot business, that business receives the information in it.

We keep backups and protect your data with reasonable security, but we are not a records-retention service. Export what you need to keep. After an account is deleted we delete or de-identify your data as the Privacy Policy describes, except where the law requires us to keep it.

8.Messaging, calling and consent

Professional and Max plans let you text and call leads and customers through a business phone number provisioned for you, and the Max plan can do some of that automatically. You are the sender. You are responsible for complying with every law that applies to your messages and calls, including the Telephone Consumer Protection Act, the CAN-SPAM Act, state telemarketing and consent laws, do-not-call rules, carrier messaging rules and any consent, identification, opt-out and record-keeping requirements. You must have the required consent before you or your AI text or call anyone, honour opt-outs immediately, and never use the Service for messages the recipient has not agreed to receive.

Carriers and messaging providers may block or filter messages, require registration of your business and use case, or suspend numbers for complaints. We may pass those requirements and consequences on to you.

9.Text messages from us

Flow Pilot Suite LLC (FlowPilot Suite) sends account and service text messages to the mobile number on your account (sign-in codes, account activation notices, service alerts, and replies to your requests) and marketing text messages only if you separately opt in. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase. The Messaging Terms are the full program terms and are part of these Terms.

10.AI features

On the Max plan, AI features draft and send replies to leads, summarise conversations and coach you, using the Business Info and instructions you provide; the AI coach in the courses is available with the courses. AI output can be wrong, incomplete or inappropriate. You must review your AI's configuration, monitor its conversations, correct it, and take responsibility for what it says on your behalf. Do not use AI features to make automated decisions that have a legal or similarly significant effect on a person, to impersonate a real person, or in any way that would mislead a customer about whether they are speaking with a human.

11.Location, drivers and deliveries

Driver and delivery features record a driver's location while they are On Duty or completing a delivery, including in the background, and show it to the business's administrators and, when the driver chooses to share an ETA, to the customer. Each driver controls this through their phone's location permissions. As the business, you are responsible for telling your drivers about this tracking and for using it lawfully. Mileage, routes and ETAs are estimates.

12.Device checks and inventory records

IMEI and serial-number checks are performed by third-party data providers. Results are informational and may be delayed, incomplete, out of date or wrong because of provider, carrier or manufacturer data. They are not a guarantee of a device's status, ownership, activation lock, blacklist status or value. Make your own checks before buying, selling or shipping a device, and comply with the laws that apply to used-device trading in your area.

13.Acceptable use

You may use the Service only for lawful business purposes. You may not:

  • enter or process a person's information, a device identifier, a message or a location unless your business is allowed to;
  • use the Service for fraud, theft, trafficking in stolen devices, harassment, unlawful surveillance, discrimination, or any breach of privacy, consumer-protection, telemarketing, export-control or sanctions law;
  • send spam, unsolicited or unlawful messages or calls, or contact anyone without the consent or other lawful basis that channel requires;
  • probe, bypass, disable or interfere with sign-in, roles, security controls, rate limits, billing controls or account boundaries, or access another business's account or data;
  • copy, scrape, resell, sublicense, reverse engineer or build a competing service from the Service, except to the limited extent the law does not allow that restriction;
  • upload malware or content that infringes anyone's rights; or
  • let an unauthorised person use your account.

14.Third-party services

The Service runs on and connects to third-party services, including Apple (App Store purchases and sign-in), Google (sign-in, hosting, push notifications), our payment processor for web billing, a communications platform and telephony carriers that provide business numbers, texting and calling, device-check data providers, an AI model provider, an email delivery provider, a video host for course lessons, and mapping and geocoding services. They are named in the Privacy Policy. Their availability, prices and rules can change and are outside our control. Your use of Apple's or Google's services is also subject to their terms.

15.Ownership and licence

We own the Service, including the apps, the software, the designs, the text and the trademarks "FlowPilot Suite", "FlowPilot" and "FlowPilot Leads". We grant you a limited, revocable, non-exclusive, non-transferable licence to use the app and the Service for your business while you comply with these Terms. Feedback you give us may be used without obligation to you.

16.Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or end your access, in whole or in part, if you break these Terms, if your use creates legal, security or abuse risk for us or others, if a carrier or provider requires it, or if a payment is refused, after any notice or cure period the law requires. Where practical we will tell you and give you a chance to export your data. Sections that by their nature should survive (including 7, 15, 17, 18, 19 and 20) survive termination.

17.Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, error-free or secure, or that device checks, ETAs, mileage, AI output, valuations or any other information will be accurate or complete.

18.Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the Service or these Terms, however caused. Our total liability for all claims in any twelve-month period will not exceed the amounts you paid us for the Service in the twelve months before the claim arose, or one hundred U.S. dollars if you paid nothing. Some jurisdictions do not allow some of these limits; in those places our liability is limited to the smallest amount the law allows.

19.Indemnity

You will defend and indemnify us, our owners, employees and contractors against claims, losses and expenses (including reasonable legal fees) arising from your data, your messages and calls, your drivers, your customers, your breach of these Terms, or your violation of law or of anyone's rights.

20.Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by applicable federal law. Any dispute that we cannot resolve informally will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction. Before filing a claim, you agree to email us and give us 30 days to try to resolve it. Nothing in this section stops either party from seeking an injunction to protect its intellectual property or data.

21.Changes to the service or these Terms

We improve the Service continuously and may add, change or remove features. We may update these Terms; when a change is material we will post the new Terms here, update the date and version at the top, and tell you in the app or by email at least 14 days before it takes effect, unless the change is required by law or to address a security or legal risk. Continuing to use the Service after a change takes effect means you accept it. If you do not, stop using the Service and cancel any subscription before the change applies.

22.Apple-specific terms

These Terms are between you and us, not Apple. For the iPhone app, Apple's Licensed Application End User License Agreement also applies; if it conflicts with these Terms about the app, the Apple EULA controls for that point. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claim relating to the app, including product liability, legal or regulatory compliance, consumer-protection claims or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms for the app and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country and are not on any U.S. government list of prohibited or restricted parties.
